Terms of Service
Effective 1 September 2026 · Last updated 1 September 2026
These terms govern your use of mindwhealth. They are written to be read. If a line of it feels unclear or unfair, email and say so — that is a faster route to an answer than a lawyer, and we would rather fix the wording than argue it later.
Who you are dealing with
mindwhealth is operated by Daniel Sillett, a sole proprietor in British Columbia, Canada. Creating an account means you accept these terms. If you do not accept them, do not use the service.
What mindwhealth is
A trading-education platform. You get:
- Written lessons on discipline, mindset, technical analysis and handling news.
- Boss exams and quests that test whether the lessons actually landed.
- A daily setup puzzle built on historical chart data.
- An AI mentor that responds to what you do in the product.
- A journal and a trading desk for recording and reviewing your own trades.
What mindwhealth is not
- Not a broker, an exchange, or a financial-services firm.
- Not a signal service and not a trade-recommendation provider.
- Not a licensed financial advisor.
- Not a custodian of your money.
We do not execute trades and we never touch your funds. Nothing here is investment advice. Every trade you place is your decision and your responsibility.
Your account
You need an email and a password. You agree to give accurate information, keep your password to yourself, tell us promptly if the account is compromised, and be at least 18. Everything that happens under your account is your responsibility.
Paying for it
- Pricing is on the pricing page. If it changes, existing subscribers get at least 30 days' notice.
- Subscriptions renew until you cancel. You can cancel any time from your subscription settings; it takes effect at the end of the period you have already paid for, and you keep access until then.
- Stripe processes the payment. We never see or store your full card number — only the last four digits and the card brand, so you can tell which card is on file.
Refunds
Seven days, no questions asked, from your first paid charge. Email hello@mindwhealth.com within those seven days and we will process it within five business days.
After seven days we do not refund part-used billing periods. If we materially change the service in a way that removes something we promised you, you can ask for a pro-rated refund within 30 days of the change.
Who owns what
We own the lessons, the exams, the daily-setup library, the mentor characters and their writing, the artwork, and the platform. You may use all of it to learn. You may not:
- Republish lesson content, in whole or in part, outside the platform.
- Resell or share access to your account.
- Scrape, mirror, or systematically download the content.
- Train another AI model on it without our written permission.
You own what you write: your journal, your Playbook, your notes, your trade records. We hold a licence to store them and show them back to you, and to pass what you send the mentor to the model that answers it. Nothing beyond that without your say-so — the Privacy Policy sets out the detail.
Using it properly
Do not use mindwhealth to:
- Break the law.
- Harass or threaten us or, when community features ship, other users.
- Reverse-engineer the platform or get around the paywall.
- Submit deliberate junk — fake journal entries to game a streak, for instance.
- Run multiple accounts to milk free trials or beta access.
We may suspend or close accounts that break these rules, and we will tell you why if you ask.
Changes and downtime
We will add, change and remove features. For material removals we aim to give 30 days' notice. We aim for high availability but do not offer a service-level guarantee. We will not refund routine downtime; if a major outage runs past 24 hours we will credit affected accounts without being asked.
The risk, stated plainly
Trading carries a substantial risk of loss. Nothing on mindwhealth is investment advice or a recommendation to place any particular trade. Past performance of any approach described here does not predict future results. You are solely responsible for what you trade and for what it costs you.
The service is provided as is and as available. We make no warranty about uptime, accuracy, fitness for a purpose, or trading outcomes.
To the fullest extent the law allows, our total liability for any claim connected to the service is capped at the greater of what you paid us in the 12 months before the claim, or CAD $100. We are not liable for indirect, incidental, special, consequential or punitive damages, and that includes lost profits and trading losses.
Ending it
You can cancel your subscription any time from your subscription settings. To delete the account itself and everything in it, email hello@mindwhealth.com and we will do it within 30 days; ask in the same email if you want a copy of your data first. Self-serve buttons for both are being built and do not exist yet.
We can suspend or close your account if you break these terms, with notice where that is feasible.
Law and disputes
These terms are governed by the laws of British Columbia, Canada, and disputes belong in the courts of British Columbia — except where consumer-protection law where you live gives you the right to use your local courts instead, which it may well do.
Changes to these terms
We can update these terms. If a change is material we will email you and post a notice in the app. Carrying on using the service after that means you accept the new version. The date at the top tells you which version you are reading.
